Solicitud de aclaración de la Sentencia C-038/20.
El memorialista, quien manifestó actuar como presidente de la Veeduría de Movilidad, pidió a la Corporación desarrollar un documento aclaratorio sobre la aplicación de la decisión adoptada en el precitado fallo, en el que se establezca que en todos los casos de tránsito debe determinarse la responsabilidad personal de la conducta reprochable, porque así lo determina el legislador en el Código Nacional de Tránsito, y no se excluya a los vehículos públicos, porque la solidaridad es aplicable para los casos relacionados con faltas a las normas de transporte, no normadas en las Leyes 769 de 2022, 1383 de 2010, ni 1843 de 2017.
Por el incumplimiento de los requisitos formales de procedencia de legitimación y oportunidad, se RECHAZA la aclaración rogada
